Lacey Act
Agencies Adopt Stakeholder Recommendations

Federal agencies have officially enacted changes designed to further streamline the declaration process. The current regulations embrace changes negotatiated by business and environmental advocates, addressing concerns arising from the difficulty involved with reporting reused, recycled, and composite materials, as well as other types of wood to the "species" level. Enforcement of the declaration requirement for many Subchapters, including those involving wood furniture has also been delayed until, at the earliest, September 1, 2010. A Federal Register notice will be published with the new deadlines at least 6 months in advance of their enactment date.

The deadline for Lacey enforcement has been delayed until, at the earliest, September 1, 2010 for the following products:

HS Code 9401 – Seats
HS 940330 – Wooden office furniture
HS940340 – Wooden kitchen furniture
HS 940350 – Wooden bedroom furniture
HS 940360 – Other wooden furniture
HS 940381 – Furniture of cane, osier,
bamboo, rattan, or similar materials

Enforcement will begin on April 1, 2010 for the following category.

HS 940169 – Seats with wood frames
