Country of Origin Rules
With the increased sourcing of products and components from abroad, many AHFA members have expressed confusion about their obligation to mark or advertise products with country-of-origin information. This confusion may stem in part from the fact that two different federal entities, the Federal Trade Commission and U.S. Customs Service, exercise jurisdiction in this area. Generally, the FTC maintains jurisdiction over claims of U.S. origin, while the Customs Service has responsibility for foreign-origin disclosure requirements. This article focuses specifically on U.S.-origin claims under the FTC's jurisdiction.

FTC Furniture Guides
In March 2002, the U.S. Federal Trade Commission voted to repeal its "Guides for the Household Furniture Industry," which set standards for describing and labeling furniture products. The agency agreed with AHFA's position that the 1973 publication was outdated and was not providing meaningful help to consumers. The Guides had also been used by plaintiffs' attorneys in deceptive marketing lawsuits, primarily concerning the description of casegoods products as "solid wood" or "cherry." Product Reporting Obligations
One of the overlooked legal responsibilities of manufacturers is the duty to report certain product liability lawsuits and suspected product hazards to the federal government. Failure to report in a timely manner can lead to multi-million dollar fines and criminal convictions. While requiring self-reporting seems to run counter to the privilege against self-incrimination, Congress and the courts have held that the interest in protecting and advancing the public safety outweighs all other concerns. This document discusses manufacturers' basic product reporting obligations.
